BLUEKAT TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of the BlueKat warehouse ordering and invoicing SaaS platform (“Service”).
By accessing or using the Service, you agree to these Terms.
Eligibility
The Service is intended exclusively for:
- Businesses
- Commercial entities
- Authorized employees and contractors
Users must be at least 18 years of age.
Account Registration
To use the Service:
- An authorized business representative must create an account.
- Account credentials must be kept confidential.
- Users are responsible for all activities under their accounts.
BlueKat reserves the right to suspend accounts for security or policy violations.
License Grant
BlueKat grants a limited, non-exclusive, non-transferable, revocable license to access and use the Service for internal business operations only.
You may not:
- Reverse engineer the software
- Resell or sublicense the Service
- Copy or distribute proprietary content
- Attempt unauthorized system access
Customer Data
Customers retain ownership of their business data.
By using the Service, you grant BlueKat a limited license to:
- Host
- Process
- Transmit
- Back up
Customer data solely for purposes of providing the Service.
Customers are responsible for:
- Accuracy of data entered
- Legal compliance regarding stored data
- Obtaining necessary permissions from third parties
Acceptable Use
You agree not to:
- Use the Service for unlawful purposes
- Interfere with system integrity
- Upload malicious code
- Attempt unauthorized data access
- Use the platform outside its intended warehouse and invoicing functions
Subscription & Payment (If Applicable)
If the Service is subscription-based:
- Fees are billed as agreed in the subscription plan.
- Fees are non-refundable unless otherwise stated.
- Failure to pay may result in suspension or termination.
Intellectual Property
All intellectual property rights in the Service remain the exclusive property of BlueKat.
Nothing in these Terms transfers ownership rights to users.
Confidentiality
Both parties agree to maintain the confidentiality of proprietary or sensitive business information disclosed through the Service.
Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE.”
BlueKat disclaims all warranties, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
We do not guarantee uninterrupted or error-free operation.
Limitation of Liability
To the maximum extent permitted by law:
BlueKat shall not be liable for:
- Indirect or consequential damages
- Loss of profits
- Business interruption
- Data loss beyond commercially reasonable recovery efforts
Total liability shall not exceed the amount paid for the Service in the preceding 12 months.
Termination
BlueKat may suspend or terminate access if:
- Terms are violated
- Payment obligations are unmet
- Security risks are identified
Upon termination:
- Access will be revoked
- Data retention policies will apply
Governing Law
These Terms are governed by the laws of the State of [Insert State], United States, without regard to conflict-of-law principles.
Modifications
We may update these Terms periodically. Continued use constitutes acceptance of revised Terms.
